ADR: Alternative Dispute Resolution. Dispute resolution options for initiating the resolution of disputes outside of a court.

 

ADRS: Alternative Dispute Resolution System. An ADR Systemic Model which supports optimal modality selection and relationship management of a dispute outside of a court.

 

C21 Contract: A standard form of Construction contract which emerged in the mid 1990's in NSW, Australia following recommendations of the Gyles Royal Commission (1992) re the Building Construction Industry also termed 'The Contract for the 21st Centaury'. The Contract has been replaced by GC21.

 

Collaborative Contracting: A means of achieving improved contract and relationship outcomes for parties and stakeholders. Includes enhanced communications, cooperation, participation, inclusivity, involvement, risk allocation, transparency, shared information, rewards as well as extended team: integration, facilitation, development.

 

Conflict Resolution: methods and approaches to manage and resolve a misunderstanding, issue or disagreement prior to entering into ADR or Litigation.

 

GC21 Contract: A standard form of Construction contract also referred to as 'Cooperative based Contracting' developed in NSW, Australia which emerged from its predecessor, the C21 Contract. GC21 is actively used in NSW, the ACT, South Australia, QLD at times, and by many NSW Local Government Regional and Metropolitan Councils.

 

LGA: Local Government Areas including Shires and Councils 

 

NEC4 Contract: A standard form contract which to some degree may be considered as a 'twin brother or sister' equivalent to the GC21 Contract. Created in the UK under similar circumstances including: Era (Time Period); Culture (Social & Government); Adversarial beginnings (Government Vs Industry); Aspirations (Relationship focus). These contracts differ in their development trajectory choices and a number of other characteristics. GC21 Relevance & Potential may involve or include: Unrealised Development Growth opportunities; Incursion and Competition; Market share drift; Industry and Client expectations; Adaptation - Continuous Learning & Improvement. 

 

MW21 Contract: A standard form of Construction contract which may be used for Minor Works building or Construction work. May at times be referred to as 'Cooperative based Contracting' which was developed in the State of NSW, Australia. The MW21 Contract emerged from its predecessor, the GC21 Contract. MW21 is actively used in NSW and the ACT including LGAs in NSW.

 

Prequalification: a system for identifying organisations or businesses with potential to successfully deliver building or construction project works and or services.  

 

RFx: Generic overarching term indicative of a Request for a Response (EOI, RFT, RFI, RFP or similar). An arrangement where opportunities to express interest or submit tender bids or similar related arrangements may be sought from organisations or businesses based on unrestricted (open), restricted (selective/selected) or other limited invitation (e.g. based on Prequalification status). Responses may be evaluated based on identified criteria such as capability, capacity, experience, resources, work familiarity, pre-agreements, performance history, understanding of brief, portfolio of work, references, recommendations.
